What is the purpose and legal basis of processing your personal data?

We are processing your personal data, depending on a specific processing operation and its legal basis, mainly for the following purposes:

  • Tax Advisory
  • data processing for the purpose of providing tax advisory services based on a contract concluded with the client;
  • legal basis of processing activities is the fulfilment of legal obligations arising to a tax advisor under Act No. 78/1992 Coll. on Tax Advisors and Slovak Chamber of Tax Advisors as amended;

 

  • Professional Advisory Services
  • data processing for the purpose of providing professional advisory services (other than tax or legal advisory services)based on a contract concluded with the client;
  • legal basis of processing activities is either the performance of a contract, taking steps prior to entering into a contract or legitimate interest of AVENIAS company in the proper provision of the service (in situations where the data subject is not a direct party to the contract to which the processing activities relate);

  • data processing for the purpose of providing legal advisory services by the law firm based on a contract concluded with the client;
  • legal basis of processing activities is the fulfilment of legal obligations arising to a law firm under Act No. 586/2003 Coll. on Advocacy and on Amendment of Act No. 455/1991 Coll. on Trade Licensing (Trade Licensing Act) as amended;

 

  • AML Procedures
  • data processing for the purpose of the fulfilment of statutory obligations of the data controller in the field of prevention against legalization of income from criminal activities and terrorist financing;
  • legal basis of processing activities is the fulfilment of legal obligations arising to AVENIAS companies under Act No. 297/2008 Coll. on Prevention Against Legalization of Income from Criminal Activities and Terrorist Financing as amended;

 

  • Recruitment
  • data processing for the purpose of listing you in the job applicant database of AVENIAS companies with the aim to fill the vacant job positions;
  • legal basis of processing activities is the applicant´s consent;

 

  • Statutory Filings
  • data processing for the purpose of administration of statutory registries of AVENIAS companies;
  • legal basis of processing activities is the fulfilment of legal obligations arising to AVENIAS companies under Act No. 395/2002 Coll. on Archives and Registries as amended and any other regulations which implement this act or impose other obligations in relation to statutory registries;

 

  • Accounting
  • data processing for the purpose of keeping accounting records of AVENIAS companies;
  • legal basis of processing activities is the fulfilment of legal obligations arising to AVENIAS companies under Act No. 431/2002 Coll. on Accounting as amended and any other regulations which implement this act or impose obligations in relation to bookkeeping;

 

  • Marketing
  • data processing for the purpose of marketing of own services of AVENIAS companies;
  • legal basis of processing activities is our legitimate interest in promoting our own services;

 

  • Exercising rights of data subjects
  • data processing for the purpose of facilitating exercise of rights of a data subject in the area of personal data protection
  • legal basis of processing activities is the fulfilment of legal obligations arising to AVENIAS companies under Act No. 18/2018 Coll. On Personal Data Protection as amended and Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

 

  • Protection of Rights of the Controller
  • data processing for the purpose of protection of rights and interests of AVENIAS companies;
  • legal basis of processing activities is our legitimate interest, except where such an interest is overridden by the interests or fundamental rights and freedoms of the data subject;

 

What categories of personal data do we process?

We are processing mainly basic categories of personal data (e.g. name, surname, title, residency address, date of birth, email addressor other data, which are commonly used in documents necessary to render our services). Specific extent of data processing depends on the purpose for which we process personal data.

We would like to point out that documents that we process during provision of our advisory services could exceptionally contain also special categories of personal data.

 

What are consequences of failure to provide us with your personal data?

Failure to provide us with required personal data could cause, in the case of data processing in the course of:

  • performance of legal obligations, that we are not able to perform an act which relates to a requirement of personal data provision (e.g. we are not able to carry out identification or verification of the identification in compliance with the anti-money laundering legislation);
  • performance of a contract to which you are a party, that we are notable to conclude the contract or to perform our contractual duties.

 

How do we process your personal data?

Processing of your personal data can be manual or automated, when your personal data is processed in our information systems or information systems of our processors.

Your personal data are processed only by selected employees or members of the statutory body. In this respect, we take care that only authorized and trained persons have access to your personal data, and that they keep confidentiality in relation to all data (personal or other) about which they learned during performance of their duties.

 

What is a source from which the personal data originate?

We collect personal data directly from you, e.g. from our communication, from identification contained in the contract, filing, email or from other electronic forms of communication.

In certain situations, we collect your personal data also from third parties, for instance, from your legal representatives or employers, public authorities or from publicly available sources (e.g. from public registries).

 

Who is the recipient of your personal data?

Depending on the purpose of data processing, we can provide your personal data to the following recipients:

  • competent state administration authorities or to public authorities (e.g.to the tax authority);
  • AVENIAS companies;
  • criminal proceeding authorities;
  • competent courts.

We provide your personal data only in the extent necessary and in the form required to achieve purposes specified in this privacy notice or to comply with legal obligations.

 

Where do we process your personal data?

We are processing your personal data only within the European Union.

 

For what period do we store your personal data?

In general, we store your personal data for a period stipulated by applicable legislation (especially by Act No. 395/2002 Coll. on Archives and Registries as amended), by a contract, or for a period during which our legitimate interest persists.

We store data, that are processed in order to comply with a legal obligation, only for a period stipulated by applicable legislation.

Personal data processed for the performance of a contract are stored for the validity period of the contract and, subsequently, until our legitimate interest persists (in general, until lapse of limitation periods, during which we may be interested in exercising or in protection of our rights, and in case of court or similar proceedings, for a period of such a proceeding and, subsequently, until lapse of a period for filing of (extra)ordinary appeals and during a proceeding that relates to such(extra)ordinary appeals).

We will store your personal data only for a necessary period.

 

What are your rights in the data protection area?

Under relevant data protection legislation (unless stipulated otherwise by generally binding regulations), you have a right to:

  • information about processing of your personal data;
  • access to your personal data, including the right to obtain a copy of your personal data that we process;
  • portability of data which you have provided to us (in a structured, commonly used and machine-readable format) and which we are processing based on your consent, in the course of a contract performance or at your request prior to entering into a contract, by automated means; you have the right to transmit those data to another controller (if such a transfer is technically feasible);
  • rectification of your wrong, inaccurate or outdated personal data using the above contact details; where accuracy of your data is questionable you can request restriction of their processing, until we are able to check their accuracy;
  • restriction of processing of personal data during which your personal data will be stored, but not processed;
  • erasure (‘right to be forgotten’)of your personal data in situations specifically allowed by data protection legislation, e.g.:
  • your personal data are no longer necessary in relation to purposes for which they were collected or otherwise processed;
  • you withdraw the consent on which the processing is based;
  • you object to processing of your personal data based on our legitimate interests; until we verify whether your legitimate grounds override those of the data controller, we will restrict processing of your personal data;
  • withdraw the consent on which the processing is based (if given), in person or using our contact details;
  • contact us using contact details specified in this privacy notice. You can contact us also in case you think that we have breached your rights under data protection legislation;
  • when you believe that in relation to processing of your personal data, your rights were breached or that you were directly affected by such a breach, you have a right to file a complaint with a supervisory authority (Úrad na ochranu osobných údajov Slovenskej republiky, address: Hraničná 4826/12, 820 07 Bratislava – Ružinov) or to a respective court.

 

What is the content of your right to object?

You have a right to object at any time to the processing of your personal data, which is performed based on our legitimate interest. You can raise such objection personally or using any of our listed contact details.

If we identify that our legitimate interest prevails over your interest or rights and freedoms, we can continue to process your personal data. When your objection will be appropriate, we stop processing your personal data for the purpose concerned.

This privacy notice is periodically reviewed and could be changed from time to time (in order to comply with legislation and to reflect our current data privacy practices). Updated versions will be available on our web site.
